We hear that the latest building codes severely restrict building on the beach. Anyone have any info on this? I think the restrictions are called POET. :confused:

I hope that the trend for protecting Tulum's beach continues. Tulum is the most desirable spot on the coast.

They have been very strict about all buildings both on the beach and even off the beach in tulum, akumal, and tankah. only in the biosphere is there any building really going on because the rules were set in place already. In Tulum, akumal and tankah the environmental rules were set up to prevent large scale development and never considered individual housing and this is the issue. The Poet/Semanrat rules basically make most of the lots unbuildable because of the codes taht were put into place for hotel size developments such as 40 meter setbacks from the ocean when most lots in Akumal and tankah are only 40 to meters in total depth.

It appears that these rules are being reanalyzed and are expected to be changed in the 1st quarter of 2005 hopefully

Thanks, that's exactly what I hear, also. our lot is 42 m long, so we were out of luck.

Thanks for the useful info! can you expand at all on exactly what the planning restrictions are on beachfront land in Tulum, or which office can i speak with to find out more?

The rules and regulations are pretty in depth. There are both local zoning and environmental rules and regulations. I think the zoning issues are fairly straightforward ie how many units or rooms per lot/hectare, building height, setbacks and etc. The problem appears to be the environmental. How close you can build to the ocean or dunes, what vegs/trees can be removed, and who makes the decision. These rules are made by the SEMANRAT who have all sorts of regulations set out in the POET document. Unfortunately, allot of the rules in the POET are apparently left up to the discretion of the agency and have not been evenly applied. Very little new construction has occurred from Akumal thru Tulum because of this. The only place where new construction is actually happening is in the biosphere where the rules are fully in place and up in the air.

The POET rules for our property in zone 7 are here http://infoteca.semarnat.gob.mx/htmlordenamiento/cancun/uga7.htm#1 and are very specific. They have applied them too all trying to build in our area, and our architect has talked to Semarnat on many occasions, they are being very literal and denying permits until POET laws changge by governmental action. Each case I have seen has not been arbitrary at all. One permit in zone 7 Akumal was given because the lot was all rock, so the 40 m setback for the turtles did not apply. Three lot owners in Tankah 3 have moved on to litigation to fight this. I think it will be April or beyond after new election before anything starts moving
